Terms of Use

Notice: These terms describe how this website may be used. They are provided for informational purposes and are not a substitute for legal advice. We recommend reviewing them with your own counsel before relying on them.

1. Agreement

By accessing or using bayislandwings.org ("the Site"), purchasing a ticket, or making a donation, you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, please do not use the Site.

2. About us

The Site is operated by Bay Island Wings Foundation ("we," "us," "our"), a 501(c)(3) nonprofit organization based in Roatán, Bay Islands, Honduras. Our mission is to empower youth in the Bay Islands through scholarships, mentorship, and community programs.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the Site. You will not:

Attempt to gain unauthorized access to any part of the Site, our database, or our service providers' systems.
Interfere with the Site's normal operation, including by introducing malware, excessive automated requests, or denial-of-service activity.
Reverse-engineer, scrape, or republish content without permission.
Misrepresent your identity when contacting us or making a payment.

4. Tickets and events

4.1 Purchase

Tickets are sold through Stripe and/or PayPal hosted checkout. Your purchase forms a contract for the specific event named at checkout. Prices are shown in U.S. dollars unless otherwise stated.

4.2 Refunds and exchanges

Tickets are generally non-refundable. We will issue a refund only in the following circumstances:

The event is cancelled by us and not rescheduled.
You contact us at least seven (7) days before the event date and we confirm a refund is possible.

Refund requests should be sent to info@bayislandwings.org with your payment reference number. Refunds are returned to the original payment method and may take 5–10 business days to appear.

4.3 Event changes and cancellations

We reserve the right to change event dates, locations, programs, or cancel events for reasons including weather, safety, or low attendance. We will notify ticket holders by email as soon as practical. If we cancel an event without rescheduling, ticket holders will receive a full refund.

4.4 Conduct at events

You agree to follow all reasonable instructions from event staff. We reserve the right to refuse entry or remove anyone whose conduct endangers others or disrupts the event, without refund.

5. Donations

Donations are voluntary contributions to support our charitable mission. They are final and non-refundable except where required by law or in cases of clear processing error.

Donation receipts will be emailed automatically. As a 501(c)(3) organization, donations may be tax-deductible to the extent permitted by U.S. law; please consult your tax advisor.

6. Intellectual property

All content on the Site — including the Bay Island Wings Foundation name, logo, text, photographs, graphics, and code — is owned by us or our licensors and is protected by copyright and other intellectual-property laws. You may share links to the Site freely. You may not copy, reproduce, or use our content for commercial purposes without written permission.

7. Third-party services and links

The Site uses third-party services for payments (Stripe, PayPal), hosting (Cloudflare), and data storage (Supabase). When you interact with these services, their own terms and privacy policies apply. We are not responsible for the content, policies, or practices of any third-party site or service.

8. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or completely secure. While we work to keep the Site available, we may suspend or discontinue any part of it at any time.

9. Limitation of liability

To the fullest extent permitted by law, Bay Island Wings Foundation, its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, attendance at any event, or any inability to use the Site.

Our total liability for any claim arising from your use of the Site or any ticket purchase will not exceed the amount you paid to us in the twelve (12) months before the claim arose.

10. Indemnification

You agree to defend and hold harmless Bay Island Wings Foundation from any claim, damage, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Site, or your conduct at any event.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Honduras, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought in the courts of Roatán, Bay Islands, Honduras, and you consent to that jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the new Terms.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
